Terms and Conditions of the EneroTrade.com Online Store

These Terms and Conditions set out the rules for using the EneroTrade.com online store operated by TRENTIX SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ

The Store sells sports footwear and clothing via the website https://EneroTrade.com.
Sales are conducted exclusively by shipment within Poland. In the future, deliveries may be extended to European Union countries. Information about changes will be published on the store’s website and in the Terms and Conditions.
These Terms and Conditions constitute the main document defining the rights and obligations of the Seller and the Customers of the online store.
The Terms and Conditions are available free of charge on the Store’s website in a manner that allows any Customer to download, save, and print them.
Acceptance of the Terms and Conditions is a necessary condition for placing an order and concluding a distance sales contract.
In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code and the Act of 30 May 2014 on Consumer Rights.
The Store is intended for consumers and entrepreneurs with consumer rights residing or having their registered office in Poland.

Customer – a natural person with full legal capacity, a legal person, or an organizational unit using the online store.
Consumer – a natural person making purchases in the Store for purposes not directly related to their business or professional activity.
Entrepreneur with consumer rights – a natural person conducting business activity who concludes a contract not directly related to the professional nature of that activity.
Product – a movable item offered by the Seller, in particular sports footwear and clothing.
Order – the Customer’s declaration of intent aimed at concluding a distance sales contract for a Product.
Sales contract – a contract concluded between the Customer and the Seller via the online store.
Customer account – an individual account created by the Customer in the online store, enabling access to orders and data.
Order form – an interactive form enabling the placement of an order.
Complaint form – a form enabling the submission of a complaint, available on the Complaint Form page.
Return form – a form enabling notification of a return of goods, available on the Return Form page.
Business days – days from Monday to Friday, excluding public holidays.
Using the online store is voluntary and free of charge.
Purchases may be made by adults with full legal capacity and by legal persons.
The Customer is obliged to provide true and up-to-date data during registration, when placing an order, or when using the Store’s services.
Registration of a customer account is not required to make a purchase.
Creating an account enables viewing order history, updating data, and managing returns and complaints.
The Customer is obliged not to transmit unlawful, offensive, or misleading content.
The Seller reserves the right to block a customer account that violates the Terms and Conditions or the law.
Technical requirements necessary to use the Store: a device with Internet access, an up-to-date browser supporting cookies and JavaScript, an active e-mail address.
The Store is not responsible for technical problems on the Customer’s side.
Orders can be placed 24 hours a day, 7 days a week via the Store’s website.
Orders placed by 13:00 on business days are shipped the same day (applies to paid and confirmed orders).
To place an order, the Customer selects products, adds them to the cart, completes the order form, selects a payment method, and confirms the order.
Order acceptance confirmation is sent to the e-mail address provided by the Customer.
The sales contract is concluded when the Customer receives confirmation that the order has been accepted for processing.
Order processing begins after the payment has been credited.
The Seller reserves the right to cancel an order in the event of:
false data being provided by the Customer,
lack of payment within 3 business days,
unavailability of the goods (the Customer will be informed, and any funds paid will be refunded within 14 days).
Each order is accompanied by a fiscal receipt or a VAT invoice (upon the Customer’s request).
EneroTrade.com provides the following electronic services:
maintaining a customer account,
enabling orders without registration,
providing contact, complaint, and return forms,
sending commercial information (newsletter – upon consent),
enabling the posting of reviews.
The agreement for the provision of electronic services is concluded for an indefinite period, from the activation of the service until its termination.
The Customer has the right to resign from electronic services at any time.
Complaints regarding electronic services may be submitted via the complaint form or by e-mail.
Complaints are processed within 14 days of receipt.

For ordered products, the Customer can pay only in advance via the Autopay online payment gateway (Przelewy24, BLIK).
The Store does not offer cash on delivery or in-person payment upon collection.
The Store does not charge any additional fees for the chosen payment method.
Order processing begins after payment is confirmed by the payment operator.
Failure to pay within 3 business days results in order cancellation.

Delivery is carried out exclusively within Poland.
The standard delivery cost is 15 zł gross.
Order processing time (from payment posting to dispatch) is up to 28 hours on business days (orders placed and paid by 13:00 are shipped the same day).
The estimated delivery time by the courier company is 1–3 business days.
The Store reserves the right to temporarily change the carrier (e.g., during peak periods or promotions), of which the Customer will be informed before placing the order.
The Store does not offer personal collection of orders.
Order status and delivery details are available after logging in and are sent to the Customer’s e-mail address.

A Customer who is a Consumer or an Entrepreneur with consumer rights has the right to withdraw from the contract without giving any reason within 14 days from receiving the product (in accordance with the Consumer Rights Act).
The right of withdrawal also applies to slightly used products (e.g., opened or tested), provided they show no signs of permanent wear and are complete.
For a return, please contact us to receive a return label. Returns are free. The received label should be affixed to the package and handed over to the courier.
To exercise the right of withdrawal, a statement must be submitted (e.g., by e-mail, via the return form, or in writing to the company’s address). The return form is available on the Return Form page.

Refunds are made without undue delay, no later than within 14 days from receiving the returned product or proof of its posting by the Customer. The refund is made using the same payment method used for the purchase.
Complaints (regarding non-conformity of the goods with the contract, damage, or defects) may be submitted by e-mail, in writing, or via the complaint form available on the Complaint Form page.
Complaints are processed within 14 days from the date they are received by the Store.
If a complaint is deemed justified, the Store will repair the product, replace it with a new one, or refund the purchase price.
The Store covers all shipping costs for complaints and returns.

All products offered in the Store are new, original, and have CE certificates and approvals required for products for children.
Products are covered by a 12-month manufacturer’s warranty, unless a longer warranty period is indicated in the product description (e.g., 24 months).
The warranty does not exclude, limit, or suspend the Customer’s rights arising from statutory warranty (rękojmia) and the non-conformity of goods with the contract.
The Store is liable for the conformity of the goods with the contract for a period of 2 years from the date the goods are handed over to the Customer (in accordance with the Consumer Rights Act).
The Customer may pursue claims under the warranty directly with the manufacturer or through the Store.

Personal data are processed for the purpose of fulfilling orders, handling accounts, complaints, returns, and sending commercial information (upon consent to the newsletter).
The Customer has the right to access their data, rectify them, delete them, and object to processing.

The Store uses CookieBot technology to ensure compliance with personal data protection and user privacy regulations.
Any disputes arising in connection with the use of the Store shall be resolved by the competent common court in accordance with Polish law.
In the event of changes to the Terms and Conditions, the new version will be published on the Store’s website and Customers who have an account will be notified.
Matters not regulated by these Terms and Conditions are subject to generally applicable provisions of Polish law.
